1. Call to Order and Introductions

Chairperson Mohler called the meeting to order at 10:01 A.M. and then read the meeting accessibility statement. Those in attendance then introduced themselves.

2. Public Comments

Richard O’Flaherty stated that he has given the MPO a letter that he has written concerning the minutes from the last MPO meeting. Richard O’Flaherty would like the MPO to look over the minutes for agenda item 4 and agenda item 9 in regard to their accuracy. Charles Kilmer responded that he believes the minutes are accurate.

3. Minutes of the June 21, 2016 Old Colony MPO Meeting

Chairperson Mohler asked the Signatories for comments or changes regarding the minutes of the June 21, 2016 meeting. The Old Colony MPO then endorsed the minutes of the June 21, 2016 Old Colony MPO Meeting. Chairperson Mohler then referenced Richard O’Flaherty’s letter and noted it would be reflected as submitted in the meeting minutes.

4. Brockton Area Transit (BAT) Report

Kelly Forrester stated that BAT has no updates at this time.

5. FFY 2017 Old Colony Unified Planning Work Program (UPWP)
· Public Comments and Potential Endorsement

Charles Kilmer stated that the FFY 2017 Old Colony UPWP has completed the 30 day public review and comment period. Comments were received from the following:

Ken Miller thanked OCPC for considering the FHWA comments. Ken Miller stated that FHWA thinks the MPO is doing a great job. By the next MPO meeting, FHWA should be able to present the results of the certification review.

Chairperson Mohler asked if there is a motion to endorse the FFY 2017 Old Colony UPWP. A motion was made and was seconded.

The Old Colony MPO voted unanimously to endorse the FFY 2017 Old Colony UPWP.

6. FFY 2016-2019 Old Colony Transportation Improvement Program (TIP) Amendment 2

Charles Kilmer stated that the FFY 2016-2019 Old Colony TIP Amendment 2 has completed the 30 day public review and comment period. Comments were received from the following:

Phil Sheppard provided a comment regarding the Brockton-Route 27/ Quincy Street/ Massasoit Boulevard Intersection Project. Phil Sheppard stated that the project is still on the TIP, but it has been moved from FFY 2018 to FFY 2021. The basis for that move is that Brockton is unable to come up with the money for the right of way acquisitions at the entrance of Massasoit Community College on Crescent Street. The College received no prior notice that the project would be moved from FFY 2018 to FFY 2021. Phil Sheppard would like Massasoit Community College to have a say in the matter before the project is moved. Charles Kilmer stated that this issue will be discussed in Agenda Item 7.

Richard O’Flaherty commented that at the JTC meeting on July 14, 2016 there were two votes against the TIP; Richard O’Flaherty being one vote, and Dan Salvucci being the other. Charles Kilmer stated that there were three action items at the JTC Meeting: 2017 UPWP; 2016-2019 TIP Amendment 2; and, the 2017-2021 TIP. The two votes were against the 2017-2021 TIP, not the 2016-2019 TIP Amendment 2.

Charles Kilmer reminded those in attendance that the 2016-2019 TIP Amendment 2 is only in regards to FFY 2016. The TIP Amendment 2 has nothing to do with the Brockton Massasoit Project or the East Bridgewater Project. Those projects will be discussed in Agenda Item 7: FFY 2017-2021 Old Colony TIP.

Chairperson Mohler asked if there is a motion to endorse the FFY 2016-2019 Old Colony TIP Amendment 2. A motion was made and was seconded.

The Old Colony MPO voted unanimously to endorse the FFY 2016-2019 Old Colony TIP Amendment 2.

7. FFY 2017-2021 Old Colony Transportation Improvement Program (TIP)
· Public Comments and Potential Endorsement

Charles Kilmer stated that the FFY 2017-2021 Old Colony TIP has completed the 30 day public review and comment period. Comments were received from the following:

Pamela Haznar provided comments on the Whitman Project (607860). The design has been revised to address a geometrical issue. Pamela Haznar then noted that bringing project from not quite 25% design to PS&E, along with the necessary right of way and permitting is overly ambitious to do in a year. Therefore, it is MassDOT's recommendation to move from 2017 to 2018. Dan Salvucci stated that he would rather have the project delayed and done right. A motion was made to move the Whitman Project (607860) from FFY 2017 to FFY 2018. The motion was seconded by Dan Salvucci.

The Old Colony MPO voted unanimously to move the Whitman Project (607860) from FFY 2017 to FFY 2018.

Pamela Haznar provided comments on the Brockton – Massasoit Boulevard Project (606143). MassDOT has worked with the City of Brockton, OCPC, and Massasoit Community College for a number of years on this project. The right of way has always been an issue. There are significant takings that MassDOT has made clear to the City of Brockton and Massasoit Community College from the beginning. It is MassDOT's recommendation to move this project from FFY 2018 to FFY 2021. The project will still be in the TIP, but it is not fair to other communities that are advancing projects if the City of Brockton is not ready to move forward.

Phil Sheppard asked if Massasoit Community College is able to come up with the money for the takings would the project get placed back into FFY 2018. David Mohler stated that would be a conversation between the City of Brockton and Massasoit Community College due to the fact that the designer has a contract with Brockton. Pamela Haznar stated that the design of the project is under the control of the City, so any right of way actions would have to be something that the City is responsible for.

Richard O’Flaherty thanked the Old Colony MPO for placing the East Bridgewater Route 18 Project back into FFY 2019.

Lee Hartmann stated that projects may move up and down every year based on their readiness. Once the technical issues are resolved, the MPO will get projects moving forward.

Chairperson Mohler asked if there is a motion to endorse the FFY 2017-2021 Old Colony TIP. A motion was made and was seconded.

The Old Colony MPO voted unanimously to endorse the FFY 2017-2021 Old Colony TIP.

8. Administrative Matters, Other Business, and Date and Time of Next Meeting(s)

Charles Kilmer stated that the date of the next MPO meeting, if needed, will be on August 16th.

Charles Kilmer summarized the MPO Coordination and Planning Area Reform Notice of Proposed Rulemaking (NPRM). The NPRM is anticipated to affect approximately 146 MPOs out of a total of 409 MPOs. Those MPOs would be required to do one of three actions:

Ken Miller stated that the USDOTs goal is to combine MPOs in one urbanized area. Comments are due by August 26th. David Mohler stated that it makes sense for each MPO to send a letter.

A motion was made for the Old Colony MPO to write a comment letter regarding the MPO Coordination Notice of Proposed Rulemaking. The motion was seconded and approved.

9. Adjournment

Chairperson Mohler adjourned the meeting at 10:58 A.M.
